EXPLANATION ON THE PROTECTION OF PERSONAL DATA AND PRIVACY POLICY

Basic information on the protection of personal data transferred to TF Tafyy LTD. ŞTİ. (“TF Tafyy”) is provided below. TF Tafyy, in order to fulfill its disclosure obligation arising from Article 10 of the Personal Data Protection Law No. 6698 (“LPPD”), presents the following explanations to the attention of our customers and third parties who use our website and/or mobile applications. TF Tafyy reserves the right to update this Personal Data Protection Explanation text at any time within the framework of possible changes in the current legislation.

1) What is the legal basis for TF Tafyy to collect personal data?

There are regulations in various laws regarding the use of our customers' personal data. First of all, the principles of protection of personal data have been determined with the KVKK. In addition, Law No. 6563 on the Regulation of Electronic Commerce also includes provisions regarding the protection of personal data. In some cases, penal sanctions have been foreseen for the protection of personal data through the provisions of the Turkish Penal Code No. 5237.

On the other hand, data must be collected and used in order to fulfill our obligations arising from the Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

To increase customer satisfaction, to be able to recognize our customers who shop from the website and/or mobile applications and to use them in customer circle analysis, to use them in various marketing and advertising activities and to organize surveys in electronic and/or physical environments through contracted organizations within this scope,
To be able to provide suggestions to our customers through our contracted institutions and solution partners and to inform our customers about our services,
To evaluate customer complaints and suggestions regarding our services,
To fulfill our legal obligations and exercise our rights arising from the current legislation,

5) How does TF Tafyy protect your personal data?

Personal data shared with TF Tafyy is under the supervision and control of TF Tafyy. TF Tafyy has assumed responsibility as the data controller to establish the necessary organization and to take and adapt technical measures in order to protect the confidentiality and integrity of information in accordance with the relevant legislation in force. Aware of our obligations in this regard, we conduct periodic penetration tests in accordance with international and national technical standards on data confidentiality and we would like to inform you that we always update our data processing policies in this context.

6) Does TF Tafyy share your personal data?

Sharing of our customers' personal data with third parties is carried out with the customers' permission, and as a rule, our customers' personal data is not transferred to third parties without their approval.

However, due to and limited to our legal obligations, personal data is shared with courts and other public institutions. In addition, personal data is transferred to contracted third parties in order to provide the services we undertake and to control the quality of the services provided.

Necessary technical and legal measures are taken to prevent violations of rights during data transfer to third parties. However, TF Tafyy is not responsible for any violations that occur due to the data protection policies of the third party receiving personal data and in the risk area under the responsibility of the third party.

Your personal data may be shared with TF Tafyy shareholders, our direct/indirect domestic/international affiliates, program partner institutions and organizations that we cooperate with in order to carry out our activities, domestic/international persons and organizations from which we receive data storage services in the cloud environment, domestic/international organizations with which we have agreements regarding sending commercial electronic messages to our customers, the Interbank Card Center, banks with which we have agreements, and various domestic and international agencies, advertising companies and survey companies and other domestic/international third parties and relevant business partners within the scope of various marketing activities in order to provide you with better service and to ensure customer satisfaction.

7) What are your rights arising from the Personal Data Protection Law?

In accordance with KVKK, your personal data;

To find out whether it is processed or not,
Requesting information if it has been processed,
To learn the purpose of processing and whether it is used in accordance with its purpose,
Knowing the third parties to whom the data is transferred domestically / abroad,
Request correction if it is processed incompletely/incorrectly,
Request deletion/destruction within the framework of the conditions set forth in Article 7 of the KVKK,
Requesting notification of the transactions made pursuant to clauses (d) and (e) above to third parties to whom the data was transferred,
To object to a result that is to your detriment due to analysis by exclusively automated systems,
We would like to remind you that you have the right to demand compensation for the damages if you suffer damages due to processing of your data in violation of the KVKK.

The rights you have under the KVKK are the obligations of TF Tafyy. We would like to inform you that we process your personal data with this awareness and to the extent required by the legislation, that in case of legal changes, we will update this information on our page in accordance with the new legislation, and that you can always easily follow the updates made on this page.

9) How can I be sure that data is kept up to date and accurate?

According to Article 4 of the KVKK, TF Tafyy is obliged to keep your personal data accurate and up-to-date. In this context, in order for TF Tafyy to fulfill its obligations arising from the current legislation, our customers must share accurate and up-to-date data with TF Tafyy.
